ESIM FREE · SUBSCRIBER AGREEMENT

The subscription, in plain terms.

Updated 30 September 2026

1. About this agreement

This Subscriber Agreement (the “Agreement”) is a binding contract between you (the “Subscriber”, “you”) and ESIM FREE, a limited liability company organized under the laws of the USA (“Esim Free”, “we”, “us”, “our”), for the purchase, activation, and use of Esim Free data-only eSIM plans sold through esimfree.io (the “Service”). By purchasing a plan, activating an eSIM, or using the Service, you confirm that you have read, understood, and accepted this Agreement in full. If you do not agree with any part of it, do not purchase, activate, or use the Service.

This Agreement applies together with the plan description shown at checkout, our Refunds page, and any written notices we send you about your subscription. In case of conflict, this Agreement controls unless a signed written amendment says otherwise. Questions about these terms can be sent to support@esimfree.io, and we reply within 24 hours. The English version of this Agreement is the controlling version.

2. Service description

Esim Free sells data-only, unlimited-5G eSIM plans for use in the United Arab Emirates over the E& and du mobile networks. Each plan provides mobile data connectivity only: voice calls and SMS/text messaging are not included and are not part of the Service, even if your device displays a network signal or a phone number. Any voice-over-IP or messaging-over-data applications you choose to install and use (such as WhatsApp calls) run over the data connection at your own responsibility and subject to their own terms.

Actual speeds, latency, and availability depend on the coverage and capacity of the underlying E& and du networks at your location, including signal strength, distance from cell sites, indoor versus outdoor use, network congestion, maintenance windows, and the capabilities of your device. 5G service is available only where the partner networks offer it and your device supports it; elsewhere the connection falls back to 4G/LTE or available technologies. The Service is provided on a best-effort basis and is designed for personal mobile use, not as a guaranteed replacement for fixed-line broadband or for uninterrupted mission-critical connectivity.

3. Eligibility and compatible devices

You must be at least 18 years old, or have the legal capacity to enter a binding contract in your jurisdiction, to purchase and use the Service. You agree to provide accurate account, contact, and payment information, to keep your account credentials and eSIM QR code confidential, and to promptly update any information that changes so that delivery, billing, and support communications reach you.

You need a carrier-unlocked, eSIM-compatible device that supports the mobile bands used by the E& and du networks in the UAE. Before purchasing, check your device against our compatibility guidance; operating-system updates, manufacturer restrictions, carrier locks, rooted or jailbroken devices, and grey-market variants can all prevent activation even on nominally supported models. Each plan supports one active device at a time, and the eSIM profile is bound to the device it is installed on. When changing devices, keep both phones on Wi-Fi, or contact support@esimfree.io for help. Except as required by mandatory consumer law, we do not refund plans that cannot be used because the subscriber’s device is incompatible, locked, or misconfigured.

4. Plans, pricing, and taxes

Current plan prices are: 1 month at 440 AED, 6 months at 2,040 AED, and 12 months at 2,880 AED. All prices are stated and billed in UAE dirhams (AED). No VAT is charged on the supply, which is treated as a US digital supply by a US limited liability company.

Our referral program gives both the referrer and the referred subscriber a 5% benefit on each side, duration-matched to the purchased plan, with no cap on the number of referrals. Referral benefits are applied as account credit or discount strictly under the program rules published at the time, cannot be combined beyond what those rules allow, and may be withheld or reversed where we reasonably suspect fraud, self-referral abuse, or manipulation. We may change or end the referral program with 30 days’ notice; referrals already earned under the prior rules are honored for the plan term to which they attached.

5. Term and renewal

Monthly plans are sold as Stripe subscriptions that continue from term to term until you cancel: each renewal is charged on every plan anniversary minus 2 days, so for example a plan that started on the 26th of the month is billed on the 24th, keeping service continuous across the boundary. Six-month and twelve-month plans are paid as a single upfront payment for the full term and likewise renew automatically for the same duration on each anniversary minus 2 days unless you cancel before the renewal date. There is no trial period: service starts when payment succeeds and the eSIM QR code is issued.

How the anniversary-minus-2-days cycle works

The minus-2-days mechanic exists so that payment clears before the new service period begins and connectivity is never interrupted by bank processing times. Your dashboard shows the current term, the next renewal date, and the amount that will be charged, and monthly subscribers receive a renewal reminder 7 days before each charge. Changing plans (for example from monthly to annual) takes effect at the next renewal only; the current paid term runs its course at the already-agreed price. Price increases, if any, apply only from your next term and only after at least 30 days’ prior notice, and you may cancel instead of accepting the new price.

6. Payment and failed payments

All payments are processed securely by Stripe using the payment method you keep on file; we do not store full card numbers on our own servers. You authorize us (via Stripe) to charge the applicable plan price to your saved payment method on each renewal date. You are responsible for keeping a valid, funded payment method attached to your account and for any foreign-exchange or bank charges your own provider applies.

If a renewal charge fails, Stripe retries the payment over a 48-hour window. During that window we may warn you by email and in your dashboard so you can fix the payment method; if payment still has not succeeded after 48 hours, the subscription may pause until the balance is paid, and repeated or persistent failures may lead to termination of the subscription with no refund of elapsed time. There are no hidden fees beyond the published plan prices and the 50 AED late fee that applies immediately when any payment fails.

7. Delivery of the eSIM and our records

Your eSIM QR code is normally issued within minutes of successful payment, delivered to your account email address and shown in your subscriber dashboard. Delivery requires a working email inbox you control, so check spam and filtering rules if the code does not arrive, and contact support@esimfree.io (replies within 24 hours) if issuance appears delayed. Risk of loss after proper delivery, for example where a QR code is deleted, shared, screenshotted publicly, or installed on the wrong device, rests with you. When changing devices, keep both phones on Wi-Fi, or contact support@esimfree.io for help.

To prove delivery and defend against payment disputes, we log order, payment, and usage evidence for each subscription, including order timestamps, Stripe payment references, QR issuance time, first activation and first use, device identifiers, and your acceptance of these terms at checkout. These records are kept under our data-retention schedule and applicable privacy law, and we may present them to Stripe, card networks, or competent authorities where needed to establish that the Service was delivered and used.

8. Cancellation

You may cancel at any time, with no retention calls and no cancellation fee: cancel from your subscriber dashboard or by emailing support@esimfree.io from your account address. Cancellation stops future renewals and takes effect at the end of the already-paid term, so your service stays on until the period you paid for expires and no further charge is made. Cancelling does not retroactively refund elapsed service except as the Refunds section below allows, and any earned referral benefit attached to a cancelled term expires with that term.

To be effective for the upcoming cycle, submit cancellation before the anniversary-minus-2-days billing date, because once the renewal charge succeeds the new paid term has begun. If you cancel after a renewal has billed, the fresh term simply runs to its end without further renewal. Nothing in this section affects your non-waivable statutory cancellation rights where you habitually reside, which apply in addition to these terms.

9. Refunds

Our refund position is as follows. Monthly plans are refundable only before the eSIM QR code is issued: once the QR code has been generated and delivered, the monthly fee is non-refundable because the digital product has been supplied and can no longer be recovered. Six-month and twelve-month plans are assessed pro-rata at the company’s discretion where a subscriber cancels early, taking into account elapsed time, data consumed, and the discounted multi-month pricing the subscriber benefited from.

Approved refunds are returned to the original Stripe payment method within a reasonable processing window after our written confirmation; Stripe and bank settlement times are outside our control. Nothing in this section limits mandatory refund rights that cannot be excluded under applicable consumer law.

10. Acceptable use and fair use

The Service is for your personal, lawful use only. You must not resell, rent, lease, share for consideration, or commercially redistribute the Service or any eSIM profile; use it for any unlawful, fraudulent, or infringing purpose; probe, attack, degrade, or interfere with the partner networks or any third-party system; send bulk unsolicited communications or automated abusive traffic; operate tethering farms, resale hotspots, or machine-to-machine fleets on a consumer plan; or attempt to circumvent network management, device binding, or these terms. Personal hotspot sharing to your own companion devices (laptop, tablet, watch) is permitted within fair use.

“Unlimited” means no fixed monthly data cap, not a right to consume network resources without limit: sustained, abnormal, or clearly non-personal usage patterns, such as continuous 24/7 bulk downloading, traffic volumes far outside ordinary smartphone use, or usage that degrades the E&/du network experience for others, may trigger proportionate fair-use measures, including speed management, temporary throttling, suspension pending review, or, for repeated or severe abuse, termination without refund. We apply these measures reasonably and, except in emergencies or where prior notice would defeat the measure, after warning you first.

11. Warranties disclaimer and network dependency

To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, or specific speeds. We expressly disclaim any guarantee of particular throughput, latency, coverage at any specific address, or continuous uptime.

Connectivity depends on third-party carrier infrastructure, the E& and du radio networks, international roaming and interconnect arrangements, and the public internet, that we do not own or control. We are therefore not responsible for outages, degradation, congestion, maintenance windows, regulatory shutdowns, spectrum or capacity constraints, SIM-provisioning failures on the carrier side, or device, operating-system, or handset-manufacturer limitations that prevent activation or use. Your sole remedy for persistent failure of the underlying network is cancellation under Section 8 and any refund available under Section 9.

12. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to this Agreement or the Service, whether in contract, tort (including negligence), or otherwise, is capped at the subscription fees you actually paid for the 3 months immediately preceding the event giving rise to the claim, or, for subscribers on 6-month or 12-month terms, the fees paid in the 12 months immediately preceding that event. In no event are we liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, even if advised of their possibility.

The exclusions in this section do not limit liability that cannot be limited by law, including liability for fraud, willful misconduct, or any consumer protection that is non-waivable in your jurisdiction. The parties agree this allocation of risk is an essential basis of the bargain reflected in the plan prices.

13. Indemnity

You agree to indemnify, defend, and hold harmless ESIM FREE, its members, officers, employees, contractors, and the underlying network partners from and against any third-party claims, damages, losses, liabilities, costs, and reasonable attorneys’ fees arising from your breach of this Agreement, your violation of any law or third-party right, your misuse of the Service (including resale, fraud, or abusive traffic), or content you transmit over the connection. We may assume exclusive control of the defense of any matter subject to indemnification, at our expense except for your indemnity obligation, and you agree to cooperate reasonably with that defense.

14. Chargebacks and payment abuse

Filing a card chargeback or payment reversal for a plan whose QR code was issued and which was activated or used is a breach of this Agreement unless a refund was first requested under Section 9 and wrongfully denied, or the charge was genuinely unauthorized or duplicated. Because eSIM profiles are irrecoverable digital goods once delivered, unjustified disputes impose network, processing, and penalty costs well beyond the plan price. Where you dispute a valid charge, we will defend the dispute with Stripe and the card networks using the order, payment, and usage evidence described in Section 7, and we may suspend or terminate the subscription, reverse related referral benefits, and recover chargeback fees and reasonable collection costs to the extent the law allows.

If you believe a charge is wrong, contact support@esimfree.io first, we reply within 24 hours, so the issue can be corrected or refunded under Section 9 without a dispute. Deliberately false disputes, repeated unjustified chargebacks, or use of stolen payment instruments are treated as fraud and handled under Section 15.

15. Suspension and termination

We may suspend or restrict the Service immediately, with notice given as soon as practicable, where reasonably necessary: unpaid fees after the 48-hour retry window; suspected fraud, chargeback abuse, resale, or material acceptable-use violations; unlawful use or a lawful order from a court, regulator, or the carrier partners; or a serious security threat to the networks or other users. For remediable breaches that are not serious, we will notify you and give you a reasonable opportunity to cure before terminating. You may cure a missed payment at any time during suspension by paying the balance, after which service is restored for the remainder of the paid term.

We may terminate this Agreement with immediate effect and without refund of elapsed service for fraud, resale, chargeback abuse, unlawful use, repeated acceptable-use violations after warning, or persistent non-payment. On any termination, the eSIM profile is deactivated, future renewals stop, and access to the dashboard may be limited to billing history. Sections covering refunds for elapsed terms, warranties, liability, indemnity, chargebacks, governing law, and this survival logic continue after termination. Either party’s termination rights are without prejudice to any accrued rights or remedies.

16. Governing law and dispute resolution

This Agreement is governed by the laws of the USA, without regard to conflict-of-law principles. Before starting any formal proceeding, the parties will attempt good-faith informal resolution: contact support@esimfree.io describing the dispute, and we will respond substantively within 24 hours and negotiate reasonably for at least 30 days. Most billing and service issues are resolved at this stage, and you agree to use this channel first.

If informal resolution fails, disputes shall be resolved exclusively in the competent federal courts located in the USA, and both parties consent to their jurisdiction and venue. Nothing in this Agreement deprives you of mandatory consumer protections of the jurisdiction where you habitually reside where those cannot be contractually waived.

17. Force majeure

Neither party is liable for delay or failure to perform (except payment of money already due) where the delay or failure results from events beyond reasonable control, including carrier-network outages or provisioning failures, cuts or failures of internet or power infrastructure, acts of regulators or governments, sanctions or export-control measures, natural disasters, pandemics, labor disputes, or armed conflict. Our obligations are suspended for the duration of the event, and where an outage materially deprives you of service for a sustained period we may, at our discretion, extend the affected term or grant a pro-rata credit under Section 9. Either party may terminate the affected subscription if a force-majeure event preventing service lasts more than 30 consecutive days.

18. Entire agreement, amendments, and contact

This Agreement, together with the plan terms accepted at checkout and any signed written amendment, is the entire agreement between you and ESIM FREE concerning the Service and supersedes all prior discussions, advertisements, and understandings on that subject. If any provision is held unenforceable, the remaining provisions continue in full force, and the unenforceable provision is modified only so far as needed to make it enforceable while preserving its intent. You may not assign this Agreement without our prior written consent; we may assign it in connection with a merger, acquisition, or sale of relevant business assets on notice to you.

We may amend this Agreement prospectively by posting the revised version on esimfree.io and notifying subscribers by email at least 30 days before the change takes effect; continued use or non-cancellation after the effective date constitutes acceptance, and you may instead cancel under Section 8 before that date if you disagree. Notices to us should be sent to support@esimfree.io, where support replies within 24 hours; notices to you go to your account email or dashboard. The headword “Esim Free” is our trading name; the contracting party is ESIM FREE, organized in the USA.
